Abstract

Abstract: This study examines the phenomenon of marriage ratification (isbat nikah) at the Kraksaan Religious Court from 2021 to 2024 from the perspective of the Compilation of Islamic Law. The primary objective of this research is to understand the juridical and normative considerations of the panel of judges in granting marriage ratification requests. Additionally, the study investigates how the judges analyze their decisions. This research employs a qualitative approach with descriptive data analysis. Data was collected through interviews and documentation; interviews were conducted with judges of the Kraksaan Religious Court, while documentation included literature and journals related to the subject. The author conducted the study by examining annual case decision reports on applications for marriage ratification of unregistered marriages (nikah sirri) at the Kraksaan Religious Court, allowing for a detailed analysis of the issue. The findings reveal that applicants for marriage ratification at the Religious Court under the jurisdiction of the Kraksaan High Religious Court typically engaged in unregistered marriages (nikah sirri). The consequences of such unregistered marriages—which lack official documentation—include numerous legal and administrative challenges: the absence of a marriage certificate, difficulties in obtaining birth certificates for children, complications in processing passports or visas for Hajj and Umrah pilgrimages, inheritance disputes, and obstacles in creating family identity cards.
