Abstract

Abstract: Divorce cases filed by wives in the Pontianak Class I-A Religious Court in the last five years have increased compared to divorce cases filed by husbands. This phenomenon is a serious issue in society, especially in the judicial world, necessitating this study to analyse the causes of the high number of divorce cases in 2018-2022 at the Pontianak Class I-A Religious Court and to analyse the legal basis for judges' decisions in divorce cases at the Pontianak Class I-A Religious Court. This research is descriptive-exploratory in nature, describing the research object in concrete terms. This type of research falls under the category of normative legal research by examining the substance of existing law. Research findings indicate that the high divorce rate in the last five years, namely from 2018 to 2022, at the Pontianak Class I-A Religious Court was caused by several factors, including adultery, drunkenness, drug abuse, gambling, abandonment of one party, imprisonment, polygamy, domestic violence, constant disputes and arguments, forced marriage, apostasy, and economic factors. The legal basis for the judge's decision in divorce cases at the Pontianak Class I-A Religious Court has several similarities, therefore judges in divorce cases at the Pontianak Class I-A Religious Court must still consider a wife's request for divorce from her husband. And judges may grant a first divorce (irrevocable divorce) if there is apparent harm in the marriage and it is difficult to reconcile
