Konstruksi Hukum Islam Terhadap Tradisi Lokal Pembagian Waris Di Lombok: Perspektif Keadilan Gender Dan Syariah

Abstract:This study aims to explore how Islamic law is constructed within the local traditions of the Sasak community, particularly in the practice of inheritance distribution in Lombok. The research focuses on three aspects: (1) the influence of local customs on inheritance practice, (2) the integration of Sharia values with local traditions, and (3) the application of gender justice principles in inheritance from the perspectives of Islamic law and traditional norms. The research employs a qualitative-descriptive approach with a sociological-normative method. Data were collected through in-depth interviews with religious leaders, traditional figures, and local communities across four districts in Lombok. The results reveal that the traditions of belembah, bebande, and assulhu serve as customary mechanisms that maintain social harmony in inheritance processes. Sasak customary law does not contradict Islamic law but adapts it through principles of deliberation and proportional justice. Awareness of women’s inheritance rights has also improved alongside education and religious understanding. This study proposes the establishment of a Village Integrated Inheritance Council (MWTD) as an institutional innovation harmonizing custom and Sharia towards contextual gender justice.
